This End User License Agreement (the “Agreement”) governs the use of FaultChain PRO, including the web-based software, calculation tools, databases, documentation and associated functionality made available through ElectroDesigner.com (the “Software”).

The Licensor is the author and/or holder of the relevant intellectual property rights in the Software. Purchases are processed through Gumroad, Inc., which acts as Merchant of Record for transactions made through Gumroad.

By purchasing, activating or using FaultChain PRO, you agree to this Agreement and the ElectroDesigner General License Terms for Digital Works. If this Agreement conflicts with the General License Terms for a matter specific to FaultChain PRO, this Agreement prevails for FaultChain PRO.

1. License grant

Subject to payment of the applicable license fee and compliance with this Agreement, the Licensor grants you a limited, non-exclusive, non-transferable and non-sublicensable license to access and use FaultChain PRO during the applicable license period.

Unless the applicable product offer explicitly states otherwise, the license is granted for one individual user.

The license permits the user to use FaultChain PRO for personal, professional and commercial engineering work, including calculations and analyses performed for the user's employer, customers or projects.

The license does not transfer ownership of FaultChain PRO, its source code, databases, algorithms, documentation or other intellectual property.

2. License period

A standard FaultChain PRO subscription provides a license for 12 months from the date of purchase or renewal.

Where recurring billing is enabled, the license will automatically renew for successive periods unless the subscription is cancelled before the next renewal date.

Cancellation prevents future renewal charges. Unless otherwise required by applicable law or the applicable Gumroad terms, cancellation does not terminate access already paid for, and the license remains valid until the end of the current paid period.

When the paid license period expires or an applicable recurring membership ends, access to PRO functionality may automatically terminate.

3. License fee and payment

The license fee is the price displayed on the applicable Gumroad product page at the time of purchase.

Payments, applicable taxes, payment processing, receipts, recurring billing and related transaction matters are handled by Gumroad as Merchant of Record.

The amount paid represents consideration for the license and associated access to FaultChain PRO for the applicable license period.

4. Permitted use

You may use FaultChain PRO to:

perform electrical engineering calculations and analyses;
evaluate electrical protection systems and fault-current chains;
use available component, cable, fuse, circuit-breaker and manufacturer-related data;
create calculation results for internal professional or commercial projects; and
use results generated by the Software in engineering documentation and reports.

Results generated using FaultChain PRO belong to the user to the extent permitted by applicable law, excluding any underlying Software, databases, proprietary algorithms or protected content belonging to the Licensor or third parties.

5. Prohibited use

You may not:

sell, rent, sublicense, distribute or transfer access to FaultChain PRO;
share your license key, activation credentials or account access with another person;
provide FaultChain PRO itself as part of another commercial software product or service;
reproduce or redistribute substantial portions of the Software or its proprietary databases;
attempt to obtain or reconstruct the source code except where such restriction is prohibited by mandatory law;
circumvent authentication, licensing, subscription or technical protection mechanisms;
systematically extract, scrape or reproduce databases contained within the Software;
use automated means to create a competing database or competing software product from FaultChain PRO; or
remove copyright, trademark or proprietary notices.

Reasonable use of individual calculation results in your engineering projects is expressly permitted.

6. Intellectual property

FaultChain PRO, including its original software code, user interface, calculation methodology, documentation, graphics, structure and original databases, remains the intellectual property of the Licensor and/or applicable third-party rights holders.

No ownership rights are transferred to the user under this Agreement.

Third-party product names, trademarks and manufacturer data remain the property of their respective owners. Reference to manufacturers such as ABB, Schneider Electric, Eaton, Littelfuse, Mersen or other manufacturers does not imply sponsorship, endorsement or affiliation unless expressly stated.

7. Manufacturer and technical data

FaultChain PRO may contain technical parameters derived from publicly available manufacturer documentation, standards-related information or other technical sources.

The Licensor attempts to maintain accurate information but does not guarantee that every manufacturer parameter is complete, current or error-free. Manufacturer documentation may be revised without notice.

Where a calculation is relevant to equipment selection, protection coordination, safety, regulatory compliance or certification, the user must verify the relevant parameters against the current official manufacturer documentation.

8. Engineering disclaimer

FaultChain PRO is an engineering calculation and decision-support tool.

It is not a substitute for professional engineering judgement, project-specific risk assessment, official manufacturer documentation, applicable standards, certification requirements or approval by the competent authority.

Electrical systems may involve risk of fire, electric shock, equipment damage, injury or death.

The user remains solely responsible for verifying that:

input data are correct;
selected components are suitable for the intended application;
calculations are appropriate for the particular installation;
current editions of applicable standards and regulations are followed; and
protection ratings, SCCR, short-circuit ratings, interrupting ratings, let-through energy, cable ratings and other safety-critical parameters are independently verified where necessary.

FaultChain PRO must not be treated as certification or regulatory approval of an electrical design.

9. Standards

References to IEC, EN, UL, NFPA, NEC, IEEE or other standards are provided for engineering reference purposes.

FaultChain PRO does not reproduce or replace the official text of those standards.

Users are responsible for obtaining and applying the appropriate official standards applicable to their jurisdiction, product and installation.

10. Updates and modifications

During an active license period, the Licensor may update, improve, replace or modify features, calculation methods, databases and user interfaces.

The Licensor may correct errors, remove obsolete data and modify features where reasonably necessary for security, legal compliance, technical integrity or continued development of the Software.

No guarantee is made that every feature will remain permanently unchanged. Material functionality described as part of the purchased product will not intentionally be removed solely for the purpose of forcing the user to purchase the same functionality again under a different license.

11. Availability

The Licensor will use reasonable efforts to maintain access to FaultChain PRO but does not guarantee uninterrupted or error-free operation.

Temporary interruptions may occur because of maintenance, hosting issues, network failures, security incidents, third-party services or circumstances outside the Licensor's reasonable control.

Nothing in this clause limits statutory rights that cannot legally be excluded.

12. Refund policy

FaultChain PRO includes a 14-day refund policy.

If FaultChain PRO materially does not operate as described, you may request a refund within 14 days of the initial purchase.

Refunds and payment reversals are processed through Gumroad and remain subject to Gumroad's transaction procedures and any mandatory rights available under applicable consumer law.

This voluntary refund policy does not restrict any statutory rights that a consumer may have under applicable law.

13. Consumer rights

Nothing in this Agreement excludes or limits rights that cannot legally be excluded or limited under applicable consumer-protection law.

Where the user qualifies as a consumer, mandatory consumer-protection provisions applicable to the transaction prevail over conflicting provisions of this Agreement.

In particular, statutory rights concerning digital content or digital services remain unaffected where applicable.

14. Limitation of liability

To the maximum extent permitted by applicable law, the Licensor shall not be liable for indirect, incidental, consequential or special damages arising from the use of FaultChain PRO, including loss of profit, loss of production, loss of data, equipment damage or losses resulting from engineering decisions based solely on Software output.

Where liability may legally be limited, the aggregate contractual liability of the Licensor arising from the Software shall not exceed the amount paid for the applicable FaultChain PRO license during the twelve months preceding the event giving rise to the claim.

This limitation does not apply where liability cannot legally be excluded or limited, including where applicable in cases of intentional misconduct or other mandatory statutory liability.

15. Suspension and termination

The Licensor may suspend or terminate a license where there is reasonable evidence of:

license sharing;
unauthorized redistribution;
circumvention of license protection;
fraudulent acquisition of a license;
systematic extraction of proprietary data; or
material violation of this Agreement.

Where reasonably possible, the user will first be given an opportunity to remedy a non-serious violation.

Termination resulting from a material breach does not create an automatic entitlement to a refund, subject to mandatory applicable law.

16. Privacy and security

Personal data associated with payments are primarily processed by Gumroad under Gumroad's applicable privacy terms.

FaultChain PRO may process limited information necessary for license activation, authentication, security and operation of the Software.

Information concerning processing carried out through ElectroDesigner.com is provided in the FaultChain data handling notice.

17. Governing law

This Agreement is governed by the laws of the Slovak Republic, without prejudice to mandatory consumer-protection rights that may apply to a consumer under the laws of the consumer's country of residence.

Nothing in this Agreement deprives a consumer of protection afforded by mandatory law that cannot be contractually excluded.

18. Changes to this Agreement

The Licensor may update this Agreement where reasonably necessary because of changes to the Software, applicable law, security requirements or the commercial operation of FaultChain PRO.

Changes that materially reduce rights relating to an already-paid license period will not apply retroactively unless required by law.

The version applicable at the time of purchase or renewal will govern that license period, except for changes required by mandatory law.

19. Severability

If any provision of this Agreement is found invalid or unenforceable, the remaining provisions remain effective to the maximum extent permitted by law.

20. Entire agreement

This Agreement, together with the ElectroDesigner General License Terms for Digital Works and the product-specific conditions presented at purchase, constitutes the license terms governing use of FaultChain PRO.

Payment-processing, billing and Merchant-of-Record matters are additionally governed by the applicable Gumroad terms.
